Terms of Rental

CHECK-IN TIME is 3 PM local time. The property manager will meet you with the keys as per your arrival schedule.
~ If you arrive early, there is no place for securing your luggage, therefore we encourage you to enjoy the beaches or excellent restaurants or attractions if you arrive in the area early.
~ Our housekeeping standards may require extra cleaning time if there is a same day checkout, which may delay check-in.
~ Although keys may be released at 3:00 p.m., no guarantee is made that properties will be cleaned by 3:00 p.m.
~ You will need to provide your flight information and planned transportation to Casa Madina (taxi, rental car, etc). This will help ensure Casa Madina agents are available to help you check-in. They will walk through the property with you to confirm the condition of the property upon check-in.
~ Arrivals after 7PM will require an additional ‘Late Checkin Fee’ of MX$500, payable on arrival in Cash.

CHECKOUT TIME is 10 AM local time. Maid service may arrive before 10 AM to start the cleaning if the house is rented again that afternoon or the next day. There is no place for securing your luggage after checkout.

RESERVATIONS - We are now offering reservations up to 12 months in advance. This allows you to lock in your dates, along with the currently advertised rental rate.

CONFIRMATION - A confirmation letter listing rules, regulations, dates of visit and property information will be emailed to you after your Initial Reservation Payment is processed. Carefully CHECK your confirmation for accuracy and email CasaMadinaPV@gmail.com immediately if any corrections are necessary; otherwise, it will be assumed correct.

LENGTH OF RENTAL - Minimum lengths of rental apply. From November 1 to April 1, 3 nights minimum. From May 1 to October 31, 2 nights minimum

This is a NON SMOKING home. If you do smoke outside or on the terrace, please properly dispose of your ashes and butts.

PROHIBITED ITEMS -
~ PETS/ANIMALS – No pets are permitted. There are stray animals and neighbors’ dogs that like to visit the house. We try to discourage cats, but are not able to keep them off the terrace and rooftop completely.
~ FIREWORKS, FIREARMS, Illegal DRUGS – All are prohibited at any Casa Madina property and are grounds for IMMEDIATE EVICTION AND FORFEITURE OF RENT and will be reported to the local police.

AGE REQUIREMENT - Neither unit will be rented to persons under 25 years of age unless accompanied by an adult guardian or parent

DAMAGE/RESERVATION DEPOSIT – A security/damage deposit is required. This must be paid as per the agreed online payment schedule. The deposit is not applied toward rent; however, it is fully refundable after departure per the rules of the online booking service, provided the following provisions are met:

No damage is done to the home or its contents, beyond normal wear and tear.

All debris, rubbish and discards are placed in dumpster, and soiled dishes are cleaned.

All keys (including Keys to the laundry room on the roof) are returned to the property manager and the home is left locked. A $50 fee will be charged for replacement of keys.

All charges accrued during the stay are paid prior to departure.
-
No linens are lost or damaged.

The home will be professionally cleaned after you leave (similar to hotel rooms). The home must be left in similar condition as found. Failure to do so will result in an additional $50 cleaning fee. The cleaning fee will be deducted from the deposit.

The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed.
~ Any damages that exceed the applicable refundable security deposit will remain your obligation and may be charged to the credit card on file (if for any reason such charges are not able to be charged to the credit card on file, you agree to pay us within ten (10) days of notice of such charges).

PAYMENT –
Rent and deposit payments and schedule are due per the rules of the booking service used. The below rules and schedule will apply when booking directly or when rules and schedule are not specified by the service.
When booking, an Initial Reservation Payment equal to 50% of the total will be required to secure the property.
~ If the grand total is less than $500.00, payment in full is due at time of reservation.
~ Payment in full at time of reservation is required if arrival occurs within 30 days.
~ Initial Reservation Payment is payable via Paypal or Venmo or a bank to bank transfer.
~ Credit cards are not accepted.
~ The Initial Reservation Payment is a portion of your rent and will be applied to your grand total; therefore, it will NOT be refunded following your departure.
~ Final payment (balance due after Initial Reservation Payment has been paid) is required 20 days prior to arrival.

TAXES AND FEES - A non-refundable processing fee of US$20, to cover expenses associated with the initial reservation, is due at reservation time and applies to all reservations.
~ IVA tax of 16% and Lodging tax of 3% is also applied.

CANCELLATIONS and REFUNDS –Cancellations will follow the rules outlined in the service used for booking. Cancellation after check-in or early departure does not warrant any refund of rent or deposit. The below rules and schedule will apply when booking directly or when rules and schedule are not specified by the service.
~ 30 days minimum notice for 100% refund
~ 14-29 days notice 50% refund
~ Less than 14 days notice, no refunds are possible
~ Cancellations, date and property changes occurring less than stated minimum days required notice (including early departures) will result in forfeiture of Initial Reservation Payment, rent, taxes and fees.
~ Refunds do not include non-refundable processing fee(s)
~ NO REFUNDS are issued for cancellations or early departure due to inclement weather or personal circumstances inside the cancellation date range.

CHANGES AND PROPERTY SUBSTITUTION - Rates, descriptions (including bed sizes), furnishings, amenities (including pools, hot tubs, etc.) and availability are subject to change WITHOUT NOTICE. No refunds will be issued for changes made by property owner or unavailable amenities.

MAXIMUM OCCUPANCY (Casa)- The maximum number of guests in the Casa is limited to eight (8) persons. An additional charge per person per night for guests in addition to the number specified in the confirmation will be assessed.

MAXIMUM OCCUPANCY (Casita)- The maximum number of guests in the Casita is limited to two (2) persons. An additional charge per person per night for guests in addition to the number specified in the confirmation will be assessed.

DECK WEIGHT/PERSON LIMITS – The rooftop deck is limited to 8 people or 1600 pounds (750 kg) at one time. No jumping or dancing on the deck.

INCLUSIVE FEES - Rates are inclusive of all fees. Includes electricity, cable TV, internet and local phone service. Shower toiletries are not included.

NO DAILY MAID SERVICE - While linens and bath and beach towels are included in the home, daily maid service is not included in the rental rate. Monthly rentals will be cleaned every two weeks. For any stay less than 2 weeks, the unit is cleaned after your stay. Additional maid service is available at an additional fee.

OWNER’S CLOSET & STORAGE – Locked owners' closet and Storage room on the rooftop terrace are not included in your rental.

PARKING – There is no parking available on Casa Madina property. Public parking is available at the top of the hill, first come first served.

RATE CHANGES - Rates subject to change without notice.

FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in

HURRICANE OR STORM POLICY - No refunds will be given unless:

The National Weather Service orders mandatory evacuation in a "Tropical Storm/Hurricane Warning area", and/or
-
A "mandatory evacuation order has been given for the Tropical Storm/Earthquake Hurricane Warning" area of residence of a vacationing guest.

The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
-
Any unused portion of rent from a guest currently registered,
-
Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and
-
Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.

WRITTEN EXCEPTIONS - Any exceptions to the above-mentioned policies must be approved in writing in advance.

MANAGEMENT – Casa Madina is privately owned. We treat all parties (owners & guests) honestly, fairly and in good faith.
~ WE RESERVE THE RIGHT to refund Initial Reservation Payments, refuse rental, or to discontinue occupancy if, in the judgment of the owner or agents, your occupancy is detrimental to the property.
~ We reserve the right for the owner or agents to enter the premises at any time for the purpose of inspection, repair, management or showing to prospective buyers or renters.
~ Property may not be used for any unlawful purpose.
~ By renting a property you are assuming all risk of and liability for any damage done to person or property, agents, employees or visitors occasioned by the present or future condition of the premises both latent and manifest. In the event damages occur during your occupancy you agree to be responsible for and reimburse the property owner for any applicable costs and attorney's fees incurred for collection of damage. Neither the owner nor owners’ agents will be responsible for accidents or injury to guest or loss of money or valuables of any kind.

MAINTENANCE ISSUES - Report all maintenance issues promptly to the Property Management agents. Just as might occur at your own well-maintained home, mechanical failures and other breakdowns could occur. Every effort will be made to correct the situation; however, no refunds or rate adjustments will be made for mechanical failures.

DAMAGE - Report any damage or breakage upon occurrence to the Property Management agents, so the matter can be settled before departure. Damages found by inspection crews upon departure will be billed and full payment for repairs will be collected

ACCIDENTS, LOSS, THEFT - Owners not responsible for accidents, injuries or illness; loss of guests’ belongings/valuables. All guests expressly assume risk of any harm arising from their (or those they invite) use of the premises.

NO GUARANTEES - Working condition of pool, air conditioners, cable TV, internet service, TVs, DVDs, appliances, etc., are NOT guaranteed. NO REFUNDS or rate adjustments will be made for mechanical failures and malfunctioning equipment. These amenities are extras provided in addition to the house or studio rental. Although all attempts will be made to correct the situation, some breakdowns cannot be prevented or repaired during your occupancy.

MAINTENANCE VISITS - Maintenance technicians and vendors may access the property for purposes of repairing previously reported issues.

CONSTRUCTION - The continued growth of our area is evidenced by new construction that may be adjacent to or near existing vacation rental properties. You may reserve a property at a time when no construction is nearby, but construction could begin prior to your arrival. We regret any inconvenience but cannot control these situations. Refunds or relocations cannot be considered.

HOMEOWNER RESPONSIBILITY - The homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
